\t\t\t\t\t \t\t\t\t\t \t\t\t\t\t Former Argentine president Cristina Fernndez de Kirchner, who has been under house arrest since 2025, announced on Wednesday that she will take her case to the United Nations Human Rights Committee, alleging violations of her fundamental rights in the proceedings that led to her conviction in the Vialidad corruption case.<\/p>\n
Kirchner, who will not be able to compete in the next presidential elections in 2027, made the announcement in an open letter, arguing that her conviction was an \u201cinstrument of political persecution and proscription.\u201d<\/p>\n
\u201cLifetime proscription is, in fact, the main sentence. The six-year prison term is merely an additional penalty,\u201d she wrote, accusing the judiciary of \u201cstructural sexism\u201d and linking what she described as judicial persecution to the 2022 assassination attempt against her.<\/p>\n
Kirchner said her petition to the UN body will be backed by Spanish legal expert Javier Borrego and Brazilian jurist Rafael Valim.<\/p>\n
The goal is for the UN Human Rights Committee to review her case and determine whether the judges who presided over her trial violated international human rights standards.<\/p>\n
What was Cristina Kirchner convicted of? Kirchner was convicted in December 2022 of fraud for steering public works contracts during her presidency (2007-2015) awarding 51 contracts in Santa Cruz province to companies owned by businessman and associate Lzaro Bez.<\/p>\n
She was sentenced to six years in prison and permanently barred from holding public office.<\/p>\n
In June 2025, Argentinas Supreme Court unanimously upheld the conviction, exhausting Kirchners remaining appeals and clearing the way for her sentence to take effect.<\/p>\n
The ruling immediately sparked criticism from Kirchner and her supporters, who have consistently described the case as an act of political persecution.<\/p>\n
Constitutional lawyer Andrs Gil Domnguez called the decision a \u201cconstitutional scandal,\u201d arguing that the Supreme Court relied on Article 280 of the Code of Civil and Commercial Procedure, which allows it to dismiss appeals without providing reasons.\u00a0<\/p>\n
He added that the Inter-American Court of Human Rights has previously told the Argentine state that the article is \u201cincompatible\u201d with the human right to a reasoned judgment.<\/p>\n
Since June 2025, Kirchner has been serving her sentence under house arrest, a benefit permitted under Argentine law for people over the age of 70. Her home has since become a regular gathering place for Peronist supporters, who assemble to express solidarity, protest the legal cases against her, and commemorate key dates related to her convictions.<\/p>\n
